Australia, check. Germany, check. United States? Not quite. Apple’s request for a preliminary injunction against the sale of Samsung’s Galaxy Tab 10.1 tablet stateside was denied today by U.S. District Judge Lucy Koh. The ruling, which was made by Koh today in a San Jose, California courthouse, is based on the struggles that Apple has and will continue to face in establishing the validity of its patents that Samsung is infringing upon.
Koh’s decision is greatly favored by mobile carriers Verizon Wireless and T-Mobile, who have publicly opposed Apple’s litigation against Samsung, since their holiday sales should no longer be cut short due to the potential ban on the Galaxy Tab 10.1.
